Terms & Conditions

These Terms & Conditions (“Terms”) apply to all scaffolding services provided by White’s Scaffolding Ltd (“the Company”, “we”, “us”) to any client (“you”, “the Customer”). By accepting a quotation, placing an order, or allowing work to commence, you agree to these Terms.

1. Definitions

Company – White’s Scaffolding Ltd.
Customer – The person, business, or organisation purchasing services.
Services – The supply, erection, alteration, inspection, hire, and dismantling of scaffolding and access equipment.
Site – The location at which the Services are to be carried out.
Contract – The agreement between the Company and the Customer for the Services.

2. Quotations & Pricing

2.1 All quotations are valid for 30 days unless stated otherwise.
2.2 Prices are based on the information provided by the Customer. Additional costs may apply if:

• Access is restricted
• Site conditions differ from those described
• Design alterations are required
• Hire periods are extended
• Additional safety measures are required by law or by the principal contractor

2.3 VAT will be added at the prevailing rate.

3. Scope of Work

3.1 The Services will be detailed in the written quotation or contract agreement.
3.2 Any additional work requested after commencement will be charged separately.
3.3 Scaffolding design drawings and calculations (if required) will only be provided if included in the quotation.

4. Access, Site Conditions & Customer Responsibilities

4.1 The Customer must ensure:

• Clear, safe access to the Site
• Ground conditions suitable to support scaffold structures
• Adequate space for vehicles, loading and unloading
• Removal of obstacles, hazards, or debris prior to erection

4.2 The Company reserves the right to delay works if Site conditions are unsafe or unsuitable.

4.3 The Customer is responsible for notifying relevant neighbours, tenants, or third parties that scaffolding is being erected.

4.4 Where scaffolding occupies a public highway or pavement, the Customer must secure all necessary permits and licences unless otherwise agreed.

5. Hire Period

5.1 The hire period begins on the date the scaffolding is erected.
5.2 The Customer will be charged for all weeks or part weeks until the scaffold is dismantled.
5.3 Minimum hire periods may apply.
5.4 Extensions to the hire period must be requested in writing.

6. Safety, Use & Protection of the Scaffold

6.1 Only authorised Company personnel may alter, move, or adapt scaffolding.
6.2 The Customer must ensure:

• No unauthorised alterations are made
• Scaffolding is not overloaded
• Netting, sheeting or signage is not added without approval
• No plant, machinery or materials are attached without permission

6.3 Damage caused by misuse, impact, vandalism, fire, or negligence will be chargeable to the Customer.

6.4 The Customer is responsible for maintaining Site security.

7. Weather & Delays

7.1 The Company is not liable for delays caused by:

• Adverse weather
• Restricted access
• Third-party delays
• Safety concerns
• Material shortages outside our control

7.2 Additional visits required due to delays not caused by the Company may be chargeable.

8. Inspections & Compliance

8.1 Scaffolding will be erected to comply with:

• Work at Height Regulations 2005
• TG20:21 or relevant NASC guidance
• CDM Regulations (where applicable)

8.2 Weekly statutory inspections may be included or may be chargeable depending on the agreement.
8.3 The Company may refuse to erect scaffolding where safety standards cannot be met.

9. Damage & Liability

9.1 The Company holds full public liability and employer’s liability insurance.
9.2 The Customer is liable for:

• Damage caused by Site operations
• Vandalism or theft
• Fire damage
• Misuse of the scaffold

9.3 The Company is not liable for:

• Loss of profit or business interruption
• Delays caused by third parties
• Damage resulting from inadequate ground conditions
• Damage caused by severe weather

10. Payments

10.1 Payment terms will be stated on the invoice or quotation.
10.2 Late payments may incur interest under the Late Payment of Commercial Debts Act.
10.3 The Company reserves the right to:

• Suspend work
• Refuse dismantling
• Remove materials

If payment is not received in accordance with agreed terms.

11. Cancellation

11.1 Cancellations must be made in writing.
11.2 Charges may apply if materials have been allocated or labour scheduled.
11.3 If works are cancelled on the day of erection, full labour costs may be charged.

12. Termination

We may terminate the Contract immediately if:

• The Customer breaches safety rules
• Payment terms are not met
• The Site becomes unsafe
• Illegal or unauthorised modifications are made to the scaffold

13. Ownership

All scaffolding equipment remains the property of White’s Scaffolding Ltd at all times.

14. Data Protection

The Company will handle personal data in accordance with GDPR and data protection law. Information will only be used for contractual and safety purposes.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in UK courts.
